WHAT IS SW® CARD?

REGULATORY FRAMEWORK
The SW® Card will be governed by the provisions issued by the regulatory bodies and the authorities empowered to oversee its operation within the territory of the Bolivarian Republic of Venezuela.
ISSUANCE
The SW® Card is owned by SW | SUPER WALLET®, which only transfers its use under the conditions set forth in this document and for the specific purpose for which it was issued. As the holder of the SW® Card, you are the custodian of the card and must be responsible for its proper use and safekeeping. If any merchant within the Visa network requires the use of the card, it is recommended that you request its deactivation in your presence to prevent unauthorized use.
It is important to note that the SW® Card is non-transferable, and SW | SUPER WALLET® will not be responsible for any use that third parties may make of your username, password, PIN, and card. Therefore, it is necessary to take care of them and not provide them to third parties.
At the time of issuing the SW® Card, the card number and security code for online transactions with merchants will be provided. If you wish to request the physical version of the SW® Card, you can do so through our website and specify the delivery location.
It is important to highlight that the SW® Card can only be handed over to the account holder, and the presentation of an original identification document will be required for its reception. SW | SUPER WALLET® reserves the right to request additional documentation and information from the applicant and/or beneficiary before issuing the SW® Card to comply with local regulations on anti-money laundering, terrorism financing, and financing the proliferation of weapons of mass destruction (AML/CTF/FPADM), as well as any other additional requirements that SW | SUPER WALLET® may impose to fulfill the objectives provided by the regulations."
OBLIGATIONS AND RESPONSIBILITY
Terms of use for the SW® Card:
The SW® Card may only be used for lawful purposes and in accordance with the current and future Terms and Conditions of Use.
It is the user's responsibility to maintain the confidentiality of the SW® Card number. In case of loss or theft, the user must immediately notify the phone number indicated on the back of the SW® Card or through the website.
The user must present their identification document at merchants when using the SW® Card.
SW | SUPER WALLET® does not guarantee uninterrupted access to the channels for using the Virtual and/or Physical SW® Card, which may not be available due to technical issues, internet failures, network unavailability, or any other reason, even beyond the control of SW | SUPER WALLET®.
The user releases SW | SUPER WALLET® from any liability for direct damages, lost profits, or any other harm or loss that may be incurred in relation to transactions with the SW® Card. The costs, charges, and fees associated with the SW® Card and its operation will be the user's responsibility.
SW | SUPER WALLET® reserves the right to make changes and modifications to the Terms and Conditions of Use at any time by simply publishing the modifications through the website. All modifications will take effect the day after their publication. The user must notify SW | SUPER WALLET® via email of their rejection of the modifications within a period of 5 (five) days from the publication. Otherwise, the user will be deemed to have accepted such modifications.
The handling and safekeeping of the physical SW® Card and the funds available on it are the exclusive responsibility of the user.
USING THE SW® CARD
To activate the SW Card, the user must access the SW | SUPER WALLET® website. The SW® Card may only be used for lawful transactions and in accordance with the Terms and Conditions of Use, which include:
Purchasing goods or services at establishments participating in the merchant network, domestically or internationally, through POS terminals or other data transmission means.
Transferring funds to other SW Wallet® users.
Withdrawing cash at enabled withdrawal points.
Any other use enabled by SW | SUPER WALLET®.
It's important to note that the SW® Card is only a means of payment and does not imply any relationship between SW | SUPER WALLET® and the user's transactions with merchants. For this reason, transactions with the SW® Card cannot be revoked or cancelled, except in exceptional cases provided by law. Any claims related to goods or services acquired with the SW® Card must be directed directly to the merchant.
Each transaction made with the SW® Card will reduce the available balance in the SW Wallet®. The user cannot perform transactions for an amount exceeding the available balance in the SW Wallet® at any given time. The available balance can be checked on the SW | SUPER WALLET® website.
The usage limit of the SW® Card will depend on the loaded and available balance in the SW Wallet® at any given time. If, for any reason, a transaction is approved without sufficient balance, the user must replenish the amount to the SW Wallet® within a maximum of 24 hours, expressly authorizing SW | SUPER WALLET® to debit the corresponding amount once the balance in the SW Wallet® is verified.
LOADING AND RELOADING
To comply with the financial regulations of the Bolivarian Republic of Venezuela,SW | SUPER WALLET® reserves the right to establish limits on the loading and reloading balances of the SW® Card, using any available means for this purpose. It's important for the user to know that the signed receipt and corresponding settlements, as well as any electronic or digital receipt issued by the Merchant for previously authorized transactions, will serve as proof of their operations and the amount of these. It's worth noting that the SW® Card does not allow for installment or installment-based purchases.
SW | SUPER WALLET® reserves the right to immediately cancel an SW® Card if misuse or fraudulent use is detected, or if there is evidence of suspicious activity that could indicate a violation of the current regulations against money laundering, financing of terrorism, and financing of the proliferation of weapons of mass destruction (AML/CFT/FATF), or other applicable provisions.
Once the SW® Card is activated, the cardholder can reload it with amounts and through channels that SW | SUPER WALLET® has enabled or may incorporate in the future. These details will be provided on the website or through other means such as social media or email.
The limits set by the company cannot be exceeded.
The new balance will be available within a maximum of 72 (seventy-two) business hours, depending on the means used to reload. The reloading fee will be as established in the Commission Annex, which SW | SUPER WALLET® will publish in the future, and will be deducted from the new available balance. The maximum amount in monthly reloads cannot exceed the limit informed to the user on the website or other means at the time of reloading.
INFORMATION ABOUT TRANSACTIONS
The user will be able to verify the operations carried out with the SW® Card by consulting their SW Wallet®. This information will include the charges, costs, and commissions that have been generated in the queried period.
LOSS, THEFT OR ROBBERY OF THE SW® CARD
In the event of loss, theft, duplication, or compromise of the security of the SW® Card, the user must immediately notify SW | SUPER WALLET® by sending an email to hello@sw.exchange.com. Upon receiving the notice, SW | SUPER WALLET® will immediately disable the SW® Card to prevent its use.
The user will be solely responsible for any transactions made with the lost, stolen, or compromised SW® Card up to 24 hours before notifying SW | SUPER WALLET®. If the user omits the notification process, they will be responsible for all purchases made with the lost, stolen, duplicated, or compromised SW® Card until its expiration or until it is recovered by SW | SUPER WALLET®.
If the SW® Card is recovered after notifying SW | SUPER WALLET®, it cannot be used, and the user will need to wait for a new SW® Card to be issued. SW | SUPER WALLET® will automatically issue a new SW® Card and deliver it according to the established delivery methods. Available balances from the reported SW® Card will be transferred to the new SW® Card. The cost of replacement will be deducted from the available balance of the SW® Card, and if there is no available balance, a new SW® Card will still be issued. The applied costs will be deducted when making the first recharge.
REPRINT DUE TO DAMAGED SW® CARD
In case the SW® Card is damaged and needs to be reprinted, the user must request the reprint through the SW | SUPER WALLET® website. The cost of the reprint can be found in the Fee Schedule. This cost will be deducted from the available balance of the card and will be based on the value established in the current or future Fee Schedule. If there is no available balance, the SW® Card will still be replaced, and the applied costs will be deducted when making the first recharge.
OF CARD VALIDITY AND/OR RENEWAL
The SW® Card is valid until the expiration date indicated on the card, and it cannot be used after that date. If the user wishes to renew it, they must request the renewal through the SW | SUPER WALLET® website.
Renewal will be done automatically unless the user specifies otherwise. For automatic renewal, the SW® Card must have had activity in the last 12 (twelve) months prior to the renewal process. If there has been no activity, SW | SUPER WALLET® will deactivate the SW® Card. The renewal cost will be deducted from the available balance on the SW® Card. If there is no available balance, the renewal of the SW® Card will still take place, and the applied costs will be deducted when making the first recharge.
During the validity of the SW® Card, the Terms and Conditions of Use established in this document will apply, as well as any other conditions that may be set in the future.
REGARDING TAXES
The user will be responsible for paying all current and future taxes that directly or indirectly affect the SW® Card, as well as expenses related to it, such as issuance, maintenance, or transactions. These taxes will be debited from the balance of the SW® Card. If the SW® Card does not have sufficient balance to cover the applicable taxes, SW | SUPER WALLET® will contact the user through the website, social media, or email to provide information on how to proceed with the payment.
REGARDING THE CANCELLATION OF THE SW® CARD
Before requesting the cancellation of the SW® Card, the user must ensure that it has no remaining balance. If the SW® Card is cancelled by decision of SW | SUPER WALLET® and it has a remaining balance, it will be refunded according to the procedures that will be established in due course.
JURISDICTION AND COMPETENCE
Any disputes arising from this Agreement or related to the use and operation of the SW® Card shall be settled in the ordinary courts of the City of Caracas, Venezuela.
By using the SW® Card, the User acknowledges having read and fully accepted the Terms and Conditions of Use described in this document.
